Tier 2 Compliance Issues ....



The Sponsor has responsibility for the prospective employee once in the UK.


Therefore Sponsors must have relevant compliance procedures and processes in place with immigration laws.

Compliance covers issues such as :
The overseas qualifications must be comparable to a UK NVQ level 3 or above and the advertising for the post is acceptable.
keeping sufficient records or informing the Home Office where the person does not turn up for work or study without permission;
Keeping and maintaing records,
reporting duties,
covers termination of contract or studies,
information of employment,
new place or study


 

 

The Sponsor must contact BIA for any significant changes.

 

BIA may conduct Compliance checks involves visits to the Sponsors premises, these may be pre- arranged and a review of the Sponsors conduct in relation to their obligations.

 

Moreover, a Sponsors Representative office may be used when conducting a site visit.
