Tier 2 Summary


There are four subcategories of Tier 2

 

1. Skilled Worker - people with a specific skilled job offer in the UK who are needed to fill a temporary gap in the labour force.


2. Intra-Company Transfer - the intra-company transfer category is for people who are being transferred to a UK branch of their organisation.


3. Sports People - for elite professional athletes and coaches.

 

4. Minister of Religion - workers within a bona fide religion.

 

The work visas are handed to the employers


Successful applicant is given up to three years to work for that employer. The period may be extended. Tier 2 ....



Tier 2 of the Points Based System replaces work permit system in the new UK Immigration rules structure.

 

Tier 2 is designed specifically for skilled and highly skilled migrant workers relocating to the UK, whom have comfirmed employment with an UK Institution, company or organisation.

 

The Employer must show a genuine business need and requirement for a role that has been advertised nationally cannot be filled by the local workforce or an employee within the European Economic Area. To fulfill that position the applicant must possess suitable skills. Such requirements include

 

- A UK degree-level qualification
- A Higher National Diploma (HND)-level qualification that is relevant to the employment
- An HND-level qualification that is not relevant to the employment plus one year's full-time work experience that is relevant to the employment, and which is at N/SVQ Level 3 or above
- At least 3 years' experience using the skills acquired by working in the position for which the permit is sought. Such experience must have been gained at N/SVQ Level 3 or above.

 

Please note if the vacancy is in a skills shortage area you do not need to advertise the position.


Tier 2 requires a sponsor for all such migrants able to give certificates of sponsorship to ensure compliance with the new Immigration rules.

 

The system allows for each non EEA migrant to be assessed via a points based system prior to acceptance by the respective sponsor. At present the threshhold pass mark is 50 points minimum covering areas such as .....Age; Qualifications; Prospective Earnings;

Then granted an certificate of sponsorship issued by a licenced employer


Then the prospective candidate is eligible to apply for entry clearance with all requested supporting documentation

 

Employers have been granted responsibility and accountability through a variety immigration compliance issues checks by the Border and Immigration Agency (BIA).
