TIER 2 POINTS BASED SYSTEM

  The Government has this morning announced that on 6th April 2011 new rules shall be introduced under Tier 2 of the Points Based System and an introduction of an Exceptional Talent category under Tier 1 of the Points Based System.

Tier 2 General

The Certificates of Sponsorship (CoS) shall be limited to 20,700 per annum. The Government has anticipated an initial high demand for CoS for the first month and therefore have allocated 4,200 for April 2011 and thereafter an allocation of 1,500 CoS per month for the following 11 months. Employers shall now be required to apply to the UK Border Agency for a CoS for a specific job in contrast to the current system where Employers are granted an allocation of CoS.

In order to satisfy the new Tier 2 criterion Migrants from outside of the European Union must have a graduate level job; speak intermediate English and satisfy the specific salary and employment requirements.

Employers with vacancies offering salaries in excess of £150,000.00 or more will not be subject to the limit of CoS that may be allocated.

Intra Company Transfers

Intra Company Transfers do not form part of the above restrictions. However please note the following changes:-

- the job(s) on offer must be on the UK Border Agency's graduate occupation list;
- only Migrants with jobs offering salaries £40,000.00 and above shall be able to stay in the United Kingdom for more than 1 year - an initial grant of 3 years, with a possible extension for up to 2 years;
- Migrants with jobs offering salaries that range between £24,000.00 to £40,000.00 are only permitted to remain in the United Kingdom for no longer than 12 months. These Migrants would not be able to return overseas and re-apply for a further 12 months.
