IMPORTANT CHANGES TO THE VISITOR RULES, INCOUNTRY SWITCHES FOR STUDENT DEPENDANTS AND WORKING HOLIDAYMAKERS

  Visitors

We have been informed by the Border & Immigration Agency that under the new rules that will come into force from 1st September 2007, anyone who enters the UK as a Visitor will not be able to study during their stay.

If it is their intention to study then they must apply for prior entry clearance at the British Diplomatic post in their home country or if they are non-visa nationals make declarations to the UK Immigration Service at the port of entry.

Please note that the course, which must be at an institution that is included on the Department for Education and Skills’ register of Education and Training Providers.

The course must be for a duration of 6 months or less and the intention is to leave the UK at the end of the six months. In these circumstances any employment is prohibited.

In-country Switching

As from 1st September 2007, in making the further changes to the in-country switching provisions the Border & Immigration Agency have sought to ensure that they only allow those people who can be said to have a legitimate expectation to progress into the Student route to do so.

This will now include:

• Work permit holders
• A sabbatical officer
• Those doing re-sits
• Participant in the Fresh Talent: Working in Scotland scheme
• Science and Engineering Graduate Scheme participant (or its successor the International Graduate Scheme)

Therefore only those people with permission to remain in the United Kingdom in the above categories are permitted to switch in-country to the Student category.

Student Dependants and Working Holidaymakers

Under the new rules change Student Dependants and Working Holidaymakers will no longer be able to switch to the student category.

They will have to return to their home country in order to make an application for entry clearance.
