Changes to the Immigration Rules for the Highly Skilled Migrant Programme

Liam Byrne, British Minister for Immigration, Nationality and Citizenship announced today a change in the Immigration Rules for the Highly Skilled Migrant Programme (HSMP). This is the first step towards a points based system for managing migration to the UK.

The introduction of the new rules means that entrepreneurs and professionals will face a rigorous but clear test of their capability to work in Britain and will help select migrants who will be the most successful in benefiting British economy.

Applicants under this scheme will be judged against a new points criteria including qualifications, previous earnings, previous UK experience as a student or employee, age and participation in an MBA scheme. A mandatory English language requirement has also been added to the programme. To ensure effective operational transition, the Immigration and Nationality Directorate will suspend the HSMP until 5 December 2006.

Applicants who intend to apply under the revised HSMP requirements should not submit their application before 5 December 2006.
Applicants for further leave made during the suspension will be accepted as valid and decided after the new rules come into effect, with applicants given the opportunity to submit new information where necessary.

Entry clearance and settlement applications under HSMP will continue to be decided as normal.
